These Terms of Use govern access to the KITI Media website, use of its features, placing orders, user registration, payment for services and interaction with the company.
By using the website, registering a client account, submitting a request, placing an order or paying for services, the user confirms that they have read and accepted these Terms of Use.

KITI Media is a digital company operating since 2007 and providing services including website development, online stores, Telegram bots, hosting, domains, online advertising, technical support, website maintenance, payment system integrations and other digital services.

2. Website use
The user undertakes to use the website only lawfully and not to perform actions that may disrupt the website, system security, the rights of other users or the rights of the company.
It is prohibited to attempt unauthorized access to the website, server, database, admin panel or other users’ accounts; use the website for fraud, spam, malicious activity or illegal actions; copy website materials without permission; upload malicious code; impersonate another person; or use the website in violation of the laws of the State of Israel.
3. Registration and client account
To place certain orders or access certain functions, the user may create a client account.
The user agrees to provide accurate and up-to-date information, including name, phone, email, company details and other information necessary for the order.
The user is responsible for keeping login and password confidential. All actions performed through the user account are considered to be performed by the user unless proven otherwise.
KITI Media may temporarily restrict or block access to an account if there is suspicion of violation of these terms, hacking attempts, fraud, unauthorized access or other unlawful use of the website.
4. Orders and service provision
The user may order services through the website, contact form, client account, email, phone, WhatsApp, Telegram or another communication channel.
The service description, price, timeline, scope of work and additional terms may be specified on the website, in a commercial proposal, invoice, correspondence, technical specification or separate agreement.
KITI Media may request additional information, materials, access credentials, texts, images, logos, company data and other details necessary to perform the order.
The timeline may depend on timely provision of information by the client, project complexity, scope of work, approval of design, texts and technical specification, and the operation of third-party services, payment systems, hosting, domains and advertising accounts.
5. Customized digital services
Many KITI Media services are customized and performed for a specific client. These include websites, online stores, Telegram bots, design, development, advertising setup, integrations, technical improvements, server setup and payment system integration.
After work begins, cancellation and refund are governed by the Refund and Cancellation Policy published on the website.
6. Prices and payment
Prices on the website may be base prices, “from” prices or estimated prices. The final cost may depend on client requirements, scope, urgency, number of languages, integrations, design, functionality and third-party expenses.
Payment may be made through the website, payment systems, bank transfer, credit card or another method agreed by the parties.
If VAT applies, it may be added to the order amount in accordance with website settings, receipt, invoice and applicable tax requirements.
KITI Media may refrain from starting an order until payment or prepayment is received unless otherwise agreed.
7. Payment systems
Payments through the website may be processed using external payment providers. KITI Media does not store full bank card details.
When paying through a third-party payment system, the user may also be subject to the terms of use and privacy policy of that provider.
KITI Media is not responsible for technical failures, delays, refusals, fees or limitations caused by third-party payment systems, banks, processors or payment gateways.
8. Cancellation and refund
Order cancellation and refunds are governed by the separate Refund and Cancellation Policy published on the website.
If work on a customized service has already begun, the refund may be partial or unavailable depending on the stage of work, actual expenses, third-party service costs and legal requirements.
9. Client materials
The client is responsible for materials provided to KITI Media, including texts, images, logos, videos, trademarks, databases, access credentials, advertising materials and other information.
By providing materials, the client confirms that they have the right to use them and transfer them to KITI Media for the order.
The client undertakes not to provide materials that infringe third-party rights, copyrights, trademarks, trade secrets, privacy rights, advertising law or other applicable rules.
10. Intellectual property
All materials of the KITI Media website, including design, texts, structure, code, graphics, logos, interface elements and other materials, are owned by KITI Media or used lawfully.
The user may not copy, modify, distribute, sell, publish or use website materials without written permission from KITI Media.
Rights to materials created for a client project are governed by the order terms, technical specification, invoice, agreement or separate arrangement between the parties.
11. Third-party services
The services may involve third-party services such as hosting, domains, SSL, payment systems, advertising accounts, Google, Meta, Telegram, email services, CRM, analytics, plugins, APIs and other tools.
KITI Media does not control third-party services and is not responsible for their failures, tariff changes, blocks, limitations, errors, termination, rule changes or technical issues.
12. Advertising and promotion
Results of advertising campaigns, SEO, promotion, Telegram advertising and other marketing services depend on many factors including competition, budget, website quality, seasonality, audience, platform settings and user behavior.
KITI Media does not guarantee a specific number of leads, sales, clicks, views, subscribers or revenue unless explicitly stated in a written agreement.
13. Website accessibility
KITI Media strives to ensure website accessibility for users with disabilities and to maintain the website in accordance with applicable Israeli accessibility requirements, including Israeli Standard 5568 and WCAG 2.0 AA recommendations.

14. Privacy and personal data

KITI Media is not responsible for failures of third-party services, actions of payment systems, banks, hosting providers, domain registrars and advertising platforms, errors caused by incorrect client data, delays caused by missing materials, indirect damages, lost profits, data loss or reputational losses unless otherwise required by law.
Nothing in these terms limits consumer rights that cannot be limited by law.
16. Changes to the website and services
KITI Media may change the website, structure, design, functions, plans, list of services, working conditions, payment methods and these Terms of Use.
The current version is published on this page. Continued use of the website after updates means acceptance of the updated terms.
17. Termination of access
KITI Media may restrict or terminate user access to the website, client account or services in case of violation of these terms, suspected fraud, security threat, unauthorized access, violation of law or harm to the company, other users or third parties.
18. Governing law and jurisdiction
These Terms of Use are governed by the laws of the State of Israel.
In case of dispute, the parties will first try to resolve it through good-faith negotiations. If the dispute is not resolved, it may be submitted to the competent court in Israel unless mandatory law provides otherwise.
